HCFA Suit Dismissed - ACA is 0 for 2

A federal district court dismissed the ACA’s HCFA (Medicare) lawsuit on October 8th in a definitive summary judgment on behalf of the government. The dismissal was very strong and came with the declaration that there were no triable issues. This all but precludes any chance at a successful appeal. The dismissal of the Medicare case without trial follows closely on the heels of a similar judicial resolution of the TRIGON case. Millions of dollars were raised for this case which never even got to trial.

This sets a potentially serious precedent that allows HMO's and insurance companies to utilize non-chiropractors for the services traditionally set for chiropractors in the Medicare law. The ruling stated, " The Court finds this argument insufficient to show that Congress intended Chiropractors to be exclusive providers of manual manipulation of the spine to correct a subluxation for purposes of Medicare. To the contrary, this argument shows, as ACA itself has pointed out, Congress did not consider the question of whether doctors should be allowed to provide this service, should they become willing and able to do so at some point in the future, because Congress “could not have imagined” the issue would arise. Since Congress did not consider the question, it is impossible that Congress intended to exclude doctors and osteopaths as ACA contends.

The International Chiropractors Association – Political Action Committee (ICA-PAC) is raffling off a brand new 2004 BMW convertible to mark the kickoff of its 2004 national fundraising campaign. Tickets are $100 per entry and only 1,000 tickets will be sold, so each entry’s chances of winning are easily 500 times greater than any state lottery. Now is a great opportunity to get very good odds on winning a new BMW while helping chiropractic in the process. But time is short and you should act NOW!

One winning ticket will be drawn from eligible entries on October 31, 2004. Winner need not be present to win. Tickets are available from all ICA Board Members and Representative Assembly members, or by calling ICA-PAC at 1-800-423-4690. You may also e-mail your request for tickets to chiro@chiropractic.org. NYK At Many Upcoming Events In Chiropractic

Over the next several weeks there are some premiere events in chiropractic that Now You know will be participating in. Here are some of the highlights:

• New Beginnings - This week New Beginnings is having their meeting in conjunction with the Association of New Jersey Chiropractors.
